Issue Group on Investment : Summary Meeting 3 - 26 June 2001 CONTINUATION OF DISCUSSIONS ON THE POSSIBLE ELEMENTS OF AN INTERNATIONAL INVESTMENT AGREEMENT 1) Flexibility in International Investment Agreements Ms Sabina Voogd of SOMO (Dutch NGO) made a presentation of the report "A sustainable balance?, International investment agreements: How they reflect the rights and responsibilities of different stakeholders. The report included an analysis of several existing International Investment Agreements, such as MIGA, the OECD Codes of liberalisation, the NAFTA and the draft MAI, which were also classified according to their level of flexibility. Following the presentation, the representative of SOMO made an assessment of the degree of flexibility included in the EC proposal for investment negotiations in the WTO. The result showed, according to Ms Voogd, that the current EC investment agenda includes several flexible elements that would allow developing countries to pursue their development policies. In particular, the definition (only FDI), the approach for admission (bottom-up), the implementation phase (to be accompanied by Technical assistance and capacity building) were the main elements in which the concept of flexibility for development is included.
