Summary of case:
The EC challenges the CVDs imposed by the Argentinean Authorities on EC imports of 3 agricultural processed products: olive oil, wheat gluten and canned peaches, CVDs further extended by decisions by those authorities in 2004. For wheat gluten, the duties were almost doubled.The EC considers Argentina to have failed to determine the existence of subsidisation by failing to properly examine the existence of any "pass-through" of benefits of the subsidies to the exported products concerned, as well as to determine the existence of material injury caused by such subsidisation, therefore acting inconsistently with Art. VI:3 of the GATT and the WTO Agreement on Subsidies and Countervailing Measures.
